Terms and Conditions

These conditions apply to all the services ordered from and provided to you by Dokora Services (“Dokora”) and by requesting services from the Dokora you agree that these conditions shall apply to those services and your order.

Definitions and Interpretations

Member: means a person or entity who has paid annual membership fee to use the offerings brought together by Dokora services.

Services: means all the concierge - travel management including air flight bookings, hotel bookings, tour bookings, trekking bookings, other lifestyle activities offered via Dokora to you.

Supplier: means a supplier engaged by Dokora on behalf of you for the goods and services.

Request: means a request placed by Member with Dokora for Dokora to arrange the supply of goods and/or services from Supplier on the Member’s behalf.

Supply of services

Dokora shall supply the Services to you, provided that Dokora shall not be required to provide or facilitate the supply of goods and/or services that it deems at its sole discretion may violate applicable laws, standards and/or regulations or may offend taste and decency in the relevant jurisdiction.

Dokora shall use its reasonable endeavors to meet any performance dates specified, but any such dates shall be estimates only and time shall not be of the essence for the performance of any services.

Dokora shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirements, or which do not materially affect the nature or quality of the Services. Dokora shall notify you in any such event.

You acknowledge that Dokora reserves the right to accept commissions upon the supply of products or performance of services by any Supplier.

Telephone calls to Dokora may be monitored or recorded for training and quality purposes.

Dokora shall provide the Services using reasonable care and skills, and as far as reasonably possible, in accordance with your requests and reasonable instructions from time to time.

Tickets

Whenever Dokora procures tickets on your behalf for any events, shows or flights, you will be held to the terms and conditions of the event organizer or airlines. Dokora suggest you read the terms and conditions of the Supplier. Such terms and conditions are likely to include terms which state that sale of tickets are final and no refunds shall be issued after the purchase has been made.

When you instruct Dokora to procure tickets to sold-out events, flights, or shows, Dokora might be able to procure tickets via its ticket agent partners. Please note that by instructing Dokora to obtain such tickets on your behalf you are agreeing to purchase tickets above face value and the total cost may include a service charge to Dokora in respect of our provision of services to obtain the seats for you. Dokora is not the seller of ticket and is not responsible for the fulfilment of our order.

In the event that a show is cancelled directly by the event organizer, artists or promoter, it may not be possible to obtain a refund of the face value of the relevant tickets.

Hotels and Resorts:

Some hotels will have specific other charges for use of their amenities, which will be charged to your account. They will have their own terms and conditions, Dokora suggests you read them. Such terms and conditions will have specific charges such as use of mini-bar, charges for extra bed or cot for infants, and different rates for stay extensions.

Tours and Trekking:

Suppliers of Tours and Trekking services will have their own terms and conditions. We suggest you read them. Such terms and conditions will have specifics related to heli-rescue, insurance, and additional charges for add ons.

Placing a request or order for services

Members may place Requests by Dokora’s website.

Dokora reserves the right to withdraw any of the Services and/or refuse to accept any Requests at its sole discretion.

If Dokora is unable to deal with any Request, it will inform the Member as soon as reasonably practicable.

You undertake that all the details you provide to us for the purpose of booking, ordering or purchasing products or services are correct.

From time to time the procurement or provision of certain services or products may incur Dokora service fee or handling charges. You will be charged extra for those services.

CANCELLATIONs, REFUNDS AND RETURNS

Member acknowledges that the sales contract for the supply of goods and/or services made as a result of a Request is between the Member and the relevant Supplier and that Dokora is not a party to such a contract. Cancellation of contracts with Suppliers should be addressed with the Supplier directly and will be subject to the relevant Supplier’s policies.

If a Request for a specific product or service is not available, Dokora may offer you substitute product or services of a similar description and standard. You may at your sole discretion refuse acceptance of such substitute products and/or services and request a full refund in the event that the payment has already been made to the Supplier for the unavailable product or service.

All description of any products of services on Dokora’s website has been approved by the relevant Supplier. Dokora shall not be held liable for inaccurate or misleading descriptions.

Payment for all products and services shall be due immediately upon acceptance of the order by the relevant Supplier.

Member acknowledges that for goods purchased on his or her behalf by Dokora directly from a Supplier, returns and exchanges will be subject to the terms and conditions of that Supplier and returns or exchange of goods purchased may not always be permitted. In circumstances, where Member has instructed Dokora to procure goods and/or services, Dokora will not be held liable if the Supplier does not accept the return or the exchange of the procured items and or services.

Dokora will hold no responsibility of customs or border clearance.

Membership fees are non-refundable.

Members will be governed by Cancellation Policies of Dokora Services stated below:

You can cancel the car service up 24 hours prior to the pick-up time. There will be no cancellation fees except for financial handling charges of 3%.

You can cancel the hotel booking without fees up to 2 weeks prior to the start of your reservation date, except for the 3% financial handling charges. If your cancellation is within the 2 weeks of the reservation date, the cancellation charges are 50% of the first night.

Your bookings for trekking are cancellable up to 2 weeks prior to the departure date with USD 100 fee. Cancellation within 2 weeks of the departure date will be charged 50% fee of the total booking fee.

Your booking for tours are cancellable up to 24 hours prior to the tour date with USD 100 fees.

Your domestic flight bookings are cancellable up to 1 week prior, with a cancellation charge of 10%.

LIMITATION OF LIABILITY

In no event will Dokora, any of its partners, providers, affiliates, including their respective officers, directors, employees or representatives, be liable for any indirect, incidental, compensatory or punitive damages or damages resulting from loss of profits, lost data or business interruption arising out of the use, inability to use, or the results of use of the service. You agree to indemnify, defend and hold harmless Dokora, its service providers, and each of their subsidiaries, affiliates, officers, directors, shareholders, beneficiaries, members, partners, employees, consultants, attorneys and agents and their respective successors and assigns, if any, (collectively the "Indemnified Parties") from and against all claims, actions, losses, liabilities, damages, costs and expenses (including, but not limited to, attorneys' fees and costs) arising from or relating to your use of the Services . Recommendations of third party vendors are at your own risk and Dokora shall not be held responsible for any dissatisfaction from any service or merchandise. The decision to use any third party service vendor is totally your own, and is only a recommendation by us and holds no guarantees for satisfaction. Any complaints, refunds, etc. should be directed to the specific vendor and not to Dokora. Dokora’s comments and recommendations presented are based on research and opinions collected by Dokora, and are subject to change at any time. In addition, all responses will be provided based upon REASONABLE research and efforts on behalf of our staff. We do not recommend utilizing our services for financial, legal, tax or other sensitive matters.

We use all reasonable endeavours to monitor the goods and/or services provided by our service partners but we cannot accept responsibility for any loss, liability or cost incurred by you as a result of any acts or omissions of service partners nor can we guarantee the accuracy of information supplied to you by service partners. No guarantees can be given on behalf of any service partners. You shall require seeking compensation for any loss or damage suffered directly from the service partner. Dokora shall not be liable to the Members , whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods; or, loss of contract, or loss of use or, loss of corruption of data or information whether direct or indirect or, any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses arising under or in connection with their Membership.

Dokora’s total liability to the Cardholder in respect of all other losses arising under or in connection with their Membership, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total value of the Member’s annual Membership Fee.

Your contract for the supply of products or services is made with the relevant Supplier only. Dokora acts as an agent for the Supplier and, unless expressly provided otherwise, all your rights and remedies are against the Supplier.

You acknowledge that any contract entered into by you with any Supplier is an independent contract. Dokora hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by you as a result of any act or omission of a Supplier whether or not arranged through Dokora.

Dokora shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from Requests or any instructions supplied by you which are incomplete, incorrect or inaccurate or arising from their late arrival or non-arrival, or any Member default.

Dokora shall not be liable to you or be deemed to be in breach of these Conditions by reason of any delay in performing, or any failure to perform, any of Dokora’s obligations in relation to the Services, if the delay or failure was due to any cause beyond Dokora’s reasonable control.

Privacy Statement

We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers.

Confidentiality

Member records are regarded as confidential and therefore will not be divulged to any third party, unless legally required to do so to the appropriate authorities. Member has the right to request sight of, and copies of any and all said Member records we keep, on the proviso that we are given reasonable notice of such a request. Members are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Dokora will only be in connection with the provision of agreed services and products.
